Terms of Service
1. About GetNorthPath
GetNorthPath (“GetNorthPath”, “we”, “us”, or “our”) operates a technology-enabled Canadian immigration support platform at getnorthpath.com. Our services include AI-powered document scanning and validation, automated IRCC form preparation, a Chrome Extension for IRCC portal data entry, Regulated Canadian Immigration Consultant (RCIC) review, and consultation booking. The platform is designed to help applicants prepare their own submissions to IRCC; it does not replace an applicant’s responsibility to review and submit their own applications.
2. Eligibility and Account Registration
You must be at least 18 years old to create an account or purchase services. By using the Service, you confirm that all information you provide is accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at info@getnorthpath.com if you become aware of any unauthorized use. We reserve the right to suspend or terminate accounts where we have reasonable grounds to believe provided information is false or misleading.
3. Free Consultation
GetNorthPath offers a complimentary 30-minute consultation to prospective clients. This is provided to help you understand which immigration pathways may be relevant to your profile and how the platform works. It does not create an ongoing professional engagement, does not constitute legal or immigration advice, and does not guarantee that any particular pathway or service package is available for your situation. A formal engagement begins only when a service agreement has been accepted and payment received.
4. Fees, Payment, and Refunds
All published service fees are shown in Canadian dollars (CAD) unless otherwise stated. Government filing fees, biometric fees, translation costs, courier charges, and any third-party disbursements are separate from GetNorthPath’s service fee and are your responsibility to pay directly to the relevant authority or provider.
Payment is processed through our secure payment provider. Fees are charged at the time of purchase or as described in your service agreement. We do not store full payment card details on our servers.
Refund eligibility and timing are set out at the point of purchase or in your service agreement. Because preparation work begins immediately upon engagement, partial or full refunds depend on the stage reached and the terms in your agreement, subject to applicable provincial consumer protection legislation.
5. Scope of AI Tools and Automated Features
Our platform uses AI-powered tools to validate documents, flag potential issues, and pre-populate government forms based on data you provide. These tools are designed to reduce errors and save time; they are not infallible and do not replace your own review. You remain responsible for verifying all information for accuracy and completeness, and for the final submission of any application to IRCC or other government authorities.
The Chrome Extension is an optional assistive tool that loads pre-validated data into your IRCC online account to support your own submission. By installing and using the extension, you confirm that you are submitting your own application and that you have reviewed all information loaded into the portal before clicking submit.
6. Scope of RCIC Consultant Review
Where your service package includes consultant review, a named Regulated Canadian Immigration Consultant (RCIC) will review your prepared application package prior to submission readiness. RCIC review is advisory and is designed to improve accuracy and completeness; it does not guarantee government approval. The consulting relationship is governed by the engagement letter or service agreement you receive at the time of onboarding. All RCICs on the GetNorthPath platform are members in good standing of the College of Immigration and Citizenship Consultants (CICC). You may verify any consultant’s standing at college-ic.ca.
7. No Guarantee of Outcomes
Immigration outcomes depend on individual facts, government policy, officer discretion, processing volumes at IRCC, and factors entirely outside our control. GetNorthPath does not guarantee approvals, specific processing times, or any particular immigration result. No statement by any GetNorthPath team member, or any material on this website, should be construed as a guarantee or promise of outcome.
8. Your Content and Uploaded Documents
By uploading documents and providing information through the Service, you grant GetNorthPath a limited, non-exclusive licence to use that content solely for the purpose of delivering the Service and as described in our Privacy Policy. You represent and warrant that you own or have the right to provide all content you submit, and that doing so does not violate any third-party rights or applicable law.
You remain solely responsible for the accuracy, completeness, and authenticity of all documents and information you provide. Submitting fraudulent, falsified, or misrepresented documents to IRCC is a serious criminal offence under Canadian law and may result in permanent inadmissibility to Canada. GetNorthPath will not assist in, and expressly prohibits, any such conduct.
9. Intellectual Property
All content on getnorthpath.com—including the platform’s software, design, text, graphics, brand elements, and proprietary tools—is owned by or licensed to GetNorthPath and is protected by applicable intellectual property laws. You may use the Service only for your own personal, non-commercial immigration preparation. You may not copy, redistribute, resell, sublicense, or create derivative works from any part of the Service without our prior written consent.
10. Prohibited Use
You agree not to:
- Use the Service in violation of any applicable law or regulation, including Canadian immigration law.
- Submit false, misleading, or fraudulent documents or information to IRCC or any government authority via or in connection with the Service.
- Attempt to gain unauthorized access to any part of the platform, other user accounts, or our systems and infrastructure.
- Use automated scripts, bots, crawlers, or scrapers to access or extract data from the platform.
- Reverse engineer, decompile, disassemble, or otherwise tamper with any part of the Service.
- Use the platform to provide paid immigration services to third parties without holding a valid RCIC licence and having appropriate agreements in place.
- Transmit viruses, malware, or any harmful code through the Service.
- Harass, abuse, threaten, or harm any GetNorthPath team member, RCIC, or other user of the platform.
11. Third-Party Services and Integrations
The Service integrates with or links to third-party tools, including consultation scheduling, payment processing, communication platforms, and government portals such as the IRCC online portal. These third-party services are governed by their own terms and privacy policies. GetNorthPath is not responsible for the availability, practices, or content of any third-party service, and your use of them is at your own risk.
12. Modifications to the Service
We may add, modify, or discontinue features of the Service at any time. Where changes materially affect an existing active engagement, we will communicate them to you directly. We will not reduce the core deliverables of a confirmed service package without your consent or a proportionate refund of the relevant fee.
13. Disclaimers
The Service is provided on an “as is” and “as available” basis to the fullest extent permitted by applicable law. We disclaim all implied warranties—including merchantability, fitness for a particular purpose, and non-infringement—except to the extent such disclaimers are not permitted by consumer protection laws applicable in your province. We do not warrant that the Service will be uninterrupted, error-free, or free from security vulnerabilities.
14. Limitation of Liability
To the maximum extent permitted by applicable law, GetNorthPath, its directors, employees, contractors, and RCIC partners will not be liable for indirect, incidental, special, consequential, or punitive damages—including loss of profits, data, goodwill, or immigration-related outcomes—arising out of or related to your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising under or related to these Terms will not exceed the total amount paid by you to GetNorthPath in the twelve months preceding the event giving rise to the claim, except where such limitation is prohibited by applicable law.
15. Indemnification
You agree to defend, indemnify, and hold harmless GetNorthPath, its team, and its RCIC partners from and against any claim, loss, liability, or expense (including reasonable legal fees) arising from your use of the Service, your breach of these Terms, or your submission of false, fraudulent, or unauthorized information or documents to any government authority.
16. Termination
Either party may terminate a service engagement as described in the applicable service agreement. We may suspend or terminate your access to the Service immediately, without notice, where we reasonably believe you have breached these Terms, engaged in illegal conduct, or pose a risk to other users or to the platform. On termination, Sections 8–15 and 17 of these Terms will continue to apply.
17. Governing Law and Dispute Resolution
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree to the non-exclusive jurisdiction of the courts located in Ontario for any dispute arising under or related to these Terms. Before initiating formal proceedings, we ask that you contact us at info@getnorthpath.com to attempt informal resolution. Nothing in this clause prevents either party from seeking emergency injunctive relief.
18. Changes to These Terms
We may update these Terms from time to time to reflect changes in our services, legal requirements, or business practices. We will post the revised Terms on this page with an updated “Last updated” date. Your continued use of the Service after changes are posted constitutes your acceptance of the updated Terms. For material changes, we will provide additional notice by email or via a prominent notice on the website where practicable.
19. Entire Agreement
These Terms, together with any applicable service agreement, engagement letter, and our Privacy Policy and Cookie Policy, constitute the entire agreement between you and GetNorthPath in relation to the Service, and supersede all prior discussions, representations, and agreements relating to the same subject matter.
